ICT Cabinet Secretary Eliud Owallo , a local area chief and some police bosses are violating the rights of a widow in Bondo by forcefully trying to grab her land.
According to the informations reaching our desks, some casual workers who were putting up some fences on the widows land to darmacate boundaries as advised by the government Surveyo were arrested and charged with trespass although they are yet to be arraigned in court
” The poor widow is now down with high blood pressure and cannot travel upcountry due to the ongoing demos, She’ is so apprehensive that CS Owalo will use his influence to grab her land,” said an area resident.
So far her fence has been brought down and the same CS is alledged to have hired some people who are putting up new fences in her absence.
The CS is yet to coment on the matter.
Another source revealed that the CS is aiding harassment and intimidation of his vulnerable subjects especially widows.
” I am a widow , I sold my land to him, actually we are vulnerable and we don’t know why he is frustrating our colleagues, our hubands died not because we wanted but because of God’s will, we want President William Ruto to intervene and tame this vice,” said another widow.
The widows have vowed to raise the matter with the president anytime from today to try and stop the issue.
” Widows voted for President Ruto not because of him but because we felt he will safeguard our rights, in conjuction with lobby groups, women for change among other organitions, we are going to seek the President’s ear anytime from now for him to talk to him even as we explore other legal ways,” said a frustrated Widow.
By the time we went to the press, the CS had unleashed the police on the said parcel of land and the media will be visiting the place for more coverage.
” We wonder why the CS has unleashed the police to terrorize a defenseless widow as per today, we think he is misguided,” Albert Omondi told our team on phone.
Another rogue person who had been, mentioned in the matter is Asst Chief Mr.Moses Mbeda.
Close sources says that he oversaw how the surveyors did their work but ironically he has now side with the CS.
” He was there as hired policemen were harassing some people on the site during their legal work,” said a resident.
He said that Mbeda was bribed with some money to oversee the illegal procedures.
He now wants Both President Ruto and Deputy Preside Rigathi Gachagua to try and tame him for the sake of the helpless in the Society.
” He even needs to be fired, he helped the police to intimidate people who were working at the plot doing their assigned work,” he added.
Yesterday , Rogue Aram Police Station OCS allowed the police to visit the place, they arrested those who were at the site whom they released today on a police cash bail.
The two men prior to their arrests were working on a private ancestral land doing some fencing to confirm boundaries .
” Yes they have been arrested, we saw the OCS doing the arrest but one of the officer leaked to us that Owallo gave the arresting orders,” said Agness Ochieng a resident.
some two months ago, the country evaded a dramatic land tussle incident when the ICT Cabinet Secretary Eliud Oketch Owallo had prepared to collude with Bondo land regestrar Diana Wanyama to forcefully grab a widow’s land by forcing a road through it despite having an alternative route. The same didn’t occur but it seems the CS who has been linked to grabbing of almost all the windows land has not given in same.
This was just one of the cases in which the CS is accused with tempering with parcels of land belonging to widows in the area.
Reliable sources indicates that all plans by then had been orchestrated and planned by Diana Wanyama, the land regestrar at Bondo land offices who is now the referee of this illegal game.Both of them are still at the offices, no changes have been made even as residents call for action.
” We shall launch a serious protests to stop the CS from the act on Friday, it can’t go this way, why grab widows land, arrests our people and behave as if you are God sent, it won’t occur,” said a senior Politician.
According to a letter in our possession that we received and is still in our possession , Wanyama is directly linked to the said illegal syndicate .
A male reliable sources who spoke to our reporter said that some police officers had also been assigned a special job of aiding the said activity by then but it failed to happen.
The letter says that Owallo is the complainant who has requested Wanyama and her office to help him get a road through the widows land to access his business facility.
“RE: Opening of access road serving parcel NO.Siaya/Member/3176, Eliud Oketch Owallo has applied to me under section 19(I) of the land Regestration act 2012 for the opening of the access road covering his above mentioned pacel of land,” the letter read in parts.
She added by threatening the parties involved including Monica Atieno Kayongo and Joseph James Wanjawa Kayongo P/NO 1692, Bonfas Ojall Onyango P/NO.3312, Siaya County Council, Agreppines Nyamboga Osonye, Ass.Chief Memba Sub-locatiin and Sub-county Surveyor Bondo.
She further added that the parties are urged to visit the place without fail so that she inspects the lands and give her position.
According to the inner circles close to the CS , the Regester has already made her mind on the issue and the meeting will only formalise her intentions .
“Take Notice, if you fail to appear at the place and the time mention the evidence of the applicant and his witness will be considered and the position of the disputed boundary determine in your absence, Failure to appear may constitute an offence under section 21(I) of the lands regestration act 2012 punishable by imprisonment for a term no not exceeding two years or a fine not exceeding two hundred Thousands or both.
According to the law, anyone who interfears with by defacing , removes, injuries or otherwise impairs a boundary feature or any part of it unless authorized to do so by the regestrar commits an offence and may be liable to such fines but not the what the regestrar says.
