Ashok Labhshanker Doshi, Harit Sheth and Magnum Properties Limited are accused of conspiring to defraud the Government of Kenya Sh 1.2 million by fraudulent means to wit “forging receipt No. C409683” that was meant for stamp duty.
The accused persons are alleged to have committed the offense between 14th May and 2nd September 1992 at Arthi House, Nairobi.
Doshi and Sheth are also charged with forgery and making a document without authority.
The court heard that the duo, jointly with others not before court, made a stamp duty receipt No. C409683 without lawful authority, purporting it to be a genuine and valid stamp duty receipt issued and signed by the commissioner of lands.
Doshi further faces a charge of forcible detainer.
It is alleged that on 5th September 2020 at Precessional Way in Nairobi, being in possession of parcel of land LR.NO. 209/3850 of Greenview Lodge Limited, withput colour of right, held possession of the said land in a manner likely to cause breach of peace or reasonable apprehension of a breach pf peace against Greenview Lodge who is entitled by law to the possession of the said land.
Doshi denied the charges before Chief Magistrate Lucas Onyina. He was released on a Sh 500,000 cash bail.
However, Sheth did plead to the charges since he did not appear in court for plea taking. Summons were issued against him.
